K\u00a0jeho p\u0159ekvapen\u00ed ov\u0161em obec p\u0159istoupila ke zm\u011bn\u011b \u00fazemn\u00edho pl\u00e1nu, kterou se zastavitelnost a vyu\u017eitelnost pozemk\u016f m\u011bla z\u00e1sadn\u011b omezit. Takov\u00e1 zm\u011bna byla p\u0159ekvapiv\u00e1, jeliko\u017e pozemky byly zastaviteln\u00e9 ji\u017e v\u00edce ne\u017e 10 let.<\/p>\n\n\n\n<p>\u010c\u00e1st pozemk\u016f obec nov\u011b pl\u00e1novala vyu\u017e\u00edt jako ve\u0159ejn\u00e9 prostranstv\u00ed a zbudovat na nich autobusovou zast\u00e1vku. \u010c\u00e1st pozemk\u016f pak m\u011bla nov\u011b slou\u017eit jako ve\u0159ejn\u00e1 zele\u0148. \u010c\u00e1st pozemk\u016f obec i nad\u00e1le ponechala ke stavebn\u00edmu vyu\u017eit\u00ed, sou\u010dasn\u011b ale v\u00fdrazn\u011b omezila zastavitelnost i v\u00fd\u0161kov\u00e9 parametry z\u00e1stavby.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Nesouhlas s navrhovan\u00fdm \u0159e\u0161en\u00edm<\/strong><\/h2>\n\n\n\n<p>Klient (tak jako v\u011bt\u0161ina z&nbsp;n\u00e1s), pravideln\u011b nesledoval \u00fa\u0159edn\u00ed desku obce. O chystan\u00e9 zm\u011bn\u011b \u00fazemn\u00edho pl\u00e1nu se n\u00e1hodou dozv\u011bd\u011bl od sv\u00e9ho zn\u00e1m\u00e9ho a ihned se na n\u00e1s obr\u00e1til s&nbsp;\u017e\u00e1dost\u00ed o pomoc.<\/p>\n\n\n\n<p>Zm\u011bnu \u00fazemn\u00edho pl\u00e1nu jsme nejprve detailn\u011b zanalyzovali a klientovi popsali , \u017ee jeho z\u00e1m\u011br nen\u00ed s&nbsp;nov\u00fdm \u00fazemn\u00edm pl\u00e1nem slu\u010diteln\u00fd. Jedin\u00e9 \u0159e\u0161en\u00ed proto bylo se proti zm\u011bn\u011b \u00fazemn\u00edho pl\u00e1nu br\u00e1nit. Po ve\u0159ejn\u00e9m projedn\u00e1n\u00ed n\u00e1vrhu t\u00e9to zm\u011bny jsme za klienta podali n\u00e1mitky, kter\u00e9 jsme podrobn\u011b a p\u0159esv\u011bd\u010div\u011b od\u016fvodnili. Obec v\u0161ak i p\u0159es na\u0161e n\u00e1mitky n zm\u011bnu \u00fazemn\u00edho pl\u00e1nu schv\u00e1lila v&nbsp;nezm\u011bn\u011bn\u00e9 podob\u011b.<\/p>\n\n\n\n<p>Zb\u00fdvala tak jedin\u00e1 mo\u017enost obrany &#8211; \u0159\u00edzen\u00ed spr\u00e1vn\u00edho soudu. K&nbsp;tomu tak\u00e9 klient p\u0159istoupil.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"771\" height=\"522\" src=\"https:\/\/kodaplegal.cz\/wp-content\/uploads\/2024\/10\/mapa.png\" alt=\"\" class=\"wp-image-2944\" srcset=\"https:\/\/kodaplegal.cz\/wp-content\/uploads\/2024\/10\/mapa.png 771w, https:\/\/kodaplegal.cz\/wp-content\/uploads\/2024\/10\/mapa-300x203.png 300w, https:\/\/kodaplegal.cz\/wp-content\/uploads\/2024\/10\/mapa-768x520.png 768w, https:\/\/kodaplegal.cz\/wp-content\/uploads\/2024\/10\/mapa-18x12.png 18w\" sizes=\"(max-width: 771px) 100vw, 771px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Usp\u011bli jsme u krajsk\u00e9ho i Nejvy\u0161\u0161\u00edho spr\u00e1vn\u00edho soudu<\/h2>\n\n\n\n<p>V&nbsp;\u0159\u00edzen\u00ed u krajsk\u00e9ho soudu jsme argumentovali protipr\u00e1vnost\u00ed postupu obce, kter\u00e1 nem\u016f\u017ee zcela sv\u00e9voln\u011b vymezit na soukrom\u00e9m pozemku ve\u0159ejn\u00e9 prostranstv\u00ed, napl\u00e1novat autobusovou zast\u00e1vku \u010di ve\u0159ejnou zele\u0148. Omezen\u00ed zastavitelnosti pozemk\u016f bylo podle na\u0161eho n\u00e1zoru nep\u0159im\u011b\u0159en\u00e9 a diskrimina\u010dn\u00ed s&nbsp;ohledem na to, \u017ee na okoln\u00edch pozemc\u00edch jin\u00fdch vlastn\u00edk\u016f k&nbsp;takov\u00e9mu omezen\u00ed nedo\u0161lo. To sam\u00e9 platilo pro v\u00fd\u0161kovou limitaci z\u00e1stavby, jeliko\u017e se v&nbsp;bezprost\u0159edn\u00ed bl\u00edzkosti pozemk\u016f klienta nach\u00e1zely stavby, kter\u00e9 jsou podstatn\u011b vy\u0161\u0161\u00ed.<\/p>\n\n\n\n<p>Krajsk\u00fd soud na\u0161emu n\u00e1vrhu zcela vyhov\u011bla ozna\u010dil vymezen\u00ed ve\u0159ejn\u00e9ho prostranstv\u00ed a ve\u0159ejn\u00e9 zelen\u011b za ned\u016fvodn\u00e9. Neshledal ani p\u0159im\u011b\u0159enost omezuj\u00edc\u00edch regulativ\u016f pro v\u00fdstavbu. Krajsk\u00fd soud obci vysv\u011btlil, \u017ee se nem\u016f\u017ee p\u0159i \u00fazemn\u00edm pl\u00e1nov\u00e1n\u00ed chovat jako p\u00e1n nad \u00fazem\u00edm a m\u011bla by postupovat tak, aby spravedliv\u011b vyva\u017eovala soukrom\u00e9 a ve\u0159ejn\u00e9 z\u00e1jmy.<\/p>\n\n\n\n<p>Obec proti rozsudku krajsk\u00e9ho soudu podala kasa\u010dn\u00ed st\u00ed\u017enost, ale Nejvy\u0161\u0161\u00ed spr\u00e1vn\u00ed soud n\u00e1m dal za pravdu a rozsudek definitivn\u011b potvrdil.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Vytvo\u0159ili jsem podm\u00ednky pro dal\u0161\u00ed spolupr\u00e1ci na v\u00fdstavb\u011b<\/h2>\n\n\n\n<p>Zru\u0161uj\u00edc\u00edm rozsudkem se pozemky klienta staly op\u011bt zastaviteln\u00e9, a to s&nbsp;p\u016fvodn\u00edmi regulativy \u00fazemn\u00edho pl\u00e1nu.<\/p>\n\n\n\n<p>Po ukon\u010den\u00ed soudn\u00edch \u0159\u00edzen\u00ed jsme iniciovali jedn\u00e1n\u00ed, na kter\u00e9m jsme obci podrobn\u011bji p\u0159edstavili z\u00e1m\u011br klienta a jeho u\u017eitek pro obec.<\/p>\n\n\n\n<p>Po n\u011bkolika dal\u0161\u00edch jedn\u00e1n\u00edch se poda\u0159ilo uzav\u0159\u00edt s&nbsp;obc\u00ed smlouvu o spolupr\u00e1ci p\u0159i realizaci z\u00e1m\u011bru. Na z\u00e1klad\u011b t\u00e9to smlouvy obec p\u0159evzala nov\u011b vzniklou komunikaci a ve\u0159ejn\u00e9 osv\u011btlen\u00ed a zav\u00e1zala se v&nbsp;dal\u0161\u00edch povolovac\u00edch procesech nepod\u00e1vat n\u00e1mitky \u010di odvol\u00e1n\u00ed. Klient na opl\u00e1tku v&nbsp;r\u00e1mci sv\u00e9ho projektu vy\u010dlenil \u010d\u00e1st bytov\u00e9ho domu pro l\u00e9ka\u0159skou ordinaci a ponechal po dohod\u011b s&nbsp;obc\u00ed okoln\u00ed zele\u0148 otev\u0159enou ve\u0159ejnosti.<\/p>\n\n\n\n<p>Klient tedy nakonec projekt realizoval v&nbsp;sou\u010dinnosti s&nbsp;obc\u00ed a povolovac\u00ed procesy se d\u00edky tomu obe\u0161ly bez pr\u016ftah\u016f a jin\u00fdch p\u0159ek\u00e1\u017eek.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"1000\" height=\"448\" src=\"https:\/\/kodaplegal.cz\/wp-content\/uploads\/2024\/10\/domy.jpg\" alt=\"\" class=\"wp-image-2945\" srcset=\"https:\/\/kodaplegal.cz\/wp-content\/uploads\/2024\/10\/domy.jpg 1000w, https:\/\/kodaplegal.cz\/wp-content\/uploads\/2024\/10\/domy-300x134.jpg 300w, https:\/\/kodaplegal.cz\/wp-content\/uploads\/2024\/10\/domy-768x344.jpg 768w, https:\/\/kodaplegal.cz\/wp-content\/uploads\/2024\/10\/domy-18x8.jpg 18w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Pom\u00e1h\u00e1me s\u00a0racionalizac\u00ed v\u00fdstavby<\/h2>\n\n\n\n<p>Poskytujeme pr\u00e1vn\u00ed slu\u017eby jak investor\u016fm, tak obc\u00edm. V\u017edy m\u00e1me z\u00e1jem nastavit spolupr\u00e1ci p\u0159i v\u00fdstavb\u011b tak, aby d\u00e1vala smysl ob\u011bma stran\u00e1m a p\u0159ede\u0161lo se zbyte\u010dn\u00fdm pr\u016ftah\u016fm a spor\u016fm. V\u00a0Liberci jsme ned\u00e1vno p\u0159ipravili aktualizaci Z\u00e1sad m\u011bsta pro jedn\u00e1n\u00ed s\u00a0investory, kter\u00e1 tvo\u0159\u00ed r\u00e1mec pr\u00e1v\u011b pro nastaven\u00ed vztah\u016f mezi soukrom\u00fdm a ve\u0159ejn\u00fdm sektorem na poli v\u00fdstavby. Pro na\u0161e klienty z\u00a0\u0159ad investor\u016f zaji\u0161\u0165ujeme pomoc p\u0159i komunikaci a pr\u00e1vn\u00edm \u0159e\u0161en\u00ed spolupr\u00e1ce s\u00a0obcemi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Nov\u00fd stavebn\u00ed z\u00e1kon<\/h2>\n\n\n\n<p>Od 1. \u010dervence 2024 nabude pln\u00e9 \u00fa\u010dinnosti nov\u00fd stavebn\u00ed z\u00e1kon. Podle nov\u00e9 pr\u00e1vn\u00ed \u00fapravy by se \u0159e\u0161en\u00ed a postup v\u00a0obdobn\u00e9m p\u0159\u00edpad\u011b p\u0159\u00edli\u0161 nezm\u011bnil. Samospr\u00e1vy budou i podle nov\u00e9 \u00fapravy rozhodovat o regulaci sv\u00e9ho \u00fazem\u00ed prost\u0159ednictv\u00edm \u00fazemn\u011b pl\u00e1novac\u00ed dokumentace. Nov\u00fd stavebn\u00ed z\u00e1kon ji\u017e nezn\u00e1 institut n\u00e1mitek, ty jsou ov\u0161em do jist\u00e9 m\u00edry nahrazeny p\u0159ipom\u00ednkami. Aktivn\u00ed \u00fa\u010dast vlastn\u00edk\u016f p\u0159i po\u0159izov\u00e1n\u00ed \u00fazemn\u011b pl\u00e1novac\u00ed dokumentace tak bude i nad\u00e1le d\u016fle\u017eit\u00e1. \u00dazemn\u00ed pl\u00e1n bude rovn\u011b\u017e mo\u017en\u00e9 napadnout n\u00e1vrhem ke spr\u00e1vn\u00edmu soudu. Nov\u00fd stavebn\u00ed z\u00e1kon krom\u011b toho nov\u011b zakotvuje institut smluv mezi samospr\u00e1vou a investory.
