Jedn\u00e1 se o vyhl\u00e1\u0161ku Ministerstva pro m\u00edstn\u00ed rozvoj \u010d. 131\/2024 Sb., o dokumentaci staveb, a vyhl\u00e1\u0161ku \u010d. 146\/2024 Sb., o po\u017eadavc\u00edch na v\u00fdstavbu. Z\u00e1konod\u00e1rce tedy nedal ve\u0159ejnosti mnoho \u010dasu na p\u0159\u00edpravu a sezn\u00e1men\u00ed se s\u00a0t\u011bmito pr\u00e1vn\u00edmi p\u0159edpisy, kter\u00e9 se z\u00e1sadn\u00edm zp\u016fsobem dotknou v\u00fdstavby v\u00a0\u010cR.<\/p>\n\n\n\n<p>Vyhl\u00e1\u0161ka o dokumentaci staveb je sp\u00ed\u0161e technick\u00fdm p\u0159edpisem, kter\u00fd stanov\u00ed, co v\u0161e m\u00e1 dokumentace pro jednotliv\u00e9 druhy staveb obsahovat. Naproti tomu vyhl\u00e1\u0161ka o po\u017eadavc\u00edch na v\u00fdstavbu obsahuje podm\u00ednky pro vymezov\u00e1n\u00ed pozemk\u016f, umis\u0165ov\u00e1n\u00ed staveb a technick\u00e9 po\u017eadavky na stavby. Nov\u00e1 vyhl\u00e1\u0161ka nahrazuje st\u00e1vaj\u00edc\u00ed p\u0159edpisy, zejm\u00e9na vyhl\u00e1\u0161ku \u010d. 268\/2009 Sb., o po\u017eadavc\u00edch na stavby a vyhl\u00e1\u0161ku \u010d. 501\/2006 Sb., o obecn\u00fdch po\u017eadavc\u00edch na vyu\u017e\u00edv\u00e1n\u00ed \u00fazem\u00ed.<\/p>\n\n\n\n<p>Podstatn\u00fdmi zm\u011bnami oproti st\u00e1vaj\u00edc\u00ed \u00faprav\u011b jsou zejm\u00e9na v oblasti regulace odstup\u016f staveb, po\u017eadavk\u016f na proslun\u011bn\u00ed, v\u00fd\u0161ky m\u00edstnost\u00ed \u010di parkovac\u00edch st\u00e1n\u00ed. Vyhl\u00e1\u0161ka o po\u017eadavc\u00edch na v\u00fdstavbu opou\u0161t\u00ed dnes aplikovan\u00fd v\u00fdpo\u010det odstup\u016f mezi rodinn\u00fdmi domy a dal\u0161\u00edmi stavbami pomoc\u00ed tzv. sklopn\u00fdch v\u00fd\u0161ek. Nov\u00e1 regulace stanov\u00ed pouze povinnost um\u00edst\u011bn\u00ed stavby ve vzd\u00e1lenosti alespo\u0148 2 m od hranice pozemku (s v\u00fdjimkou hranice s\u00a0ve\u0159ejn\u00fdm prostranstv\u00edm). Po\u017eadavek na odstupy staveb je vymezen obecn\u011b tak, \u017ee um\u00edst\u011bn\u00edm stavby <em>nesm\u00ed b\u00fdt znemo\u017en\u011bna budouc\u00ed z\u00e1stavba sousedn\u00edho pozemku nebo ohro\u017eena st\u00e1vaj\u00edc\u00ed z\u00e1stavba sousedn\u00edho pozemku<\/em>. <\/p>\n\n\n\n<p>Dal\u0161\u00ed obecn\u00e9 pravidlo pak obsahuje nov\u00fd stavebn\u00ed z\u00e1kon v\u00a0ustanoven\u00ed \u00a7 144. Podle n\u011bj vz\u00e1jemn\u00e9 odstupy staveb mus\u00ed spl\u0148ovat po\u017eadavky <em>urbanistick\u00e9, architektonick\u00e9 a po\u017eadavky stanoven\u00e9 prov\u00e1d\u011bc\u00edm pr\u00e1vn\u00edm p\u0159edpisem a jin\u00fdmi pr\u00e1vn\u00edmi p\u0159edpisy.<\/em> I podle nov\u00e9 \u00fapravy bude nad\u00e1le mo\u017en\u00e9 ud\u011blen\u00ed v\u00fdjimky z\u00a0po\u017eadavku na odstupy staveb.<\/p>\n\n\n\n<p>Vyhl\u00e1\u0161ka o po\u017eadavc\u00edch na v\u00fdstavbu p\u0159ich\u00e1z\u00ed s\u00a0benevolentn\u011bj\u0161\u00edmi po\u017eadavky na proslun\u011bn\u00ed, osv\u011btlen\u00ed a st\u00edn\u011bn\u00ed. Podle \u00fa\u010dinn\u00e9 \u00fapravy je fakticky nutn\u00e9 dos\u00e1hnut\u00ed p\u0159\u00edm\u00e9ho denn\u00edho prosv\u011btlen\u00ed bytu, co\u017e m\u016f\u017ee komplikovat \u010di \u00fapln\u011b znemo\u017e\u0148ovat rekonstrukce n\u011bkter\u00fdch byt\u016f. Podle nov\u00e9 vyhl\u00e1\u0161ky je po\u017eadavek na proslun\u011bn\u00ed do zna\u010dn\u00e9 m\u00edry redukov\u00e1n. Proslun\u011bny mus\u00ed b\u00fdt nov\u011b pouze pobytov\u00e9 m\u00edstnosti ve stavb\u00e1ch pro soci\u00e1ln\u00ed slu\u017eby a herny v mate\u0159sk\u00fdch \u0161kol\u00e1ch (s v\u00fdjimkou lesn\u00edch mate\u0159sk\u00fdch \u0161kol). \u00daprava pamatuje tak\u00e9 na proluky, u kter\u00fdch se n\u011bkter\u00e9 po\u017eadavky v\u016fbec nepou\u017eij\u00ed. Parametry pro denn\u00ed osv\u011btlen\u00ed a st\u00edn\u011bn\u00ed budou n\u00e1sledn\u011b rozvedeny v technick\u00e9 norm\u011b.\u00a0<\/p>\n\n\n\n<p>Podle nov\u00e9 vyhl\u00e1\u0161ky je sv\u011btl\u00e1 v\u00fd\u0161ka obytn\u00e9 m\u00edstnosti nebo pobytov\u00e9 m\u00edstnosti stavby pro bydlen\u00ed stanovena na minim\u00e1ln\u011b 2,5 m. V&nbsp;n\u011bkter\u00fdch p\u0159\u00edpadech (nap\u0159. u podkrov\u00ed) m\u016f\u017ee b\u00fdt sv\u011btl\u00e1 v\u00fd\u0161ka dokonce d\u00e1le sn\u00ed\u017eena. Jedn\u00e1 se tedy op\u011bt o sn\u00ed\u017een\u00ed sou\u010dasn\u00fdch po\u017eadavk\u016f stanoven\u00fdch vyhl\u00e1\u0161kou \u010d. 268\/2009 Sb.<\/p>\n\n\n\n<p>Co se t\u00fd\u010de dnes velice aktu\u00e1ln\u00edho t\u00e9matu parkovac\u00edch st\u00e1n\u00ed, vyhl\u00e1\u0161ka o po\u017eadavc\u00edch na v\u00fdstavbu stanov\u00ed, \u017ee v\u00a0p\u0159\u00edpad\u011b staveb pro bydlen\u00ed je t\u0159eba zajistit jedno parkovac\u00ed st\u00e1n\u00ed na ka\u017ed\u00fdch 120 m<sup>2<\/sup> \u010dist\u00e9 podlahov\u00e9 plochy. Jedn\u00e1 se op\u011bt o z\u00e1sadn\u00ed sn\u00ed\u017een\u00ed n\u00e1rok\u016f na stavebn\u00edky. Pro srovn\u00e1n\u00ed, pracovn\u00ed n\u00e1vrh vyhl\u00e1\u0161ky po\u010d\u00edtal se dv\u011bma parkovac\u00edmi st\u00e1n\u00edmi pro byt nad 70 m<sup>2<\/sup>.<\/p>\n\n\n\n<p>Nov\u00e1 pr\u00e1vn\u00ed \u00faprava tedy p\u0159in\u00e1\u0161\u00ed v\u00fdrazn\u011b liber\u00e1ln\u011bj\u0161\u00ed po\u017eadavky na v\u00fdstavbu staveb pro bydlen\u00ed. Uveden\u00fd p\u0159\u00edstup by pro stavebn\u00edky mohl znamenat podstatn\u00e9 zjednodu\u0161en\u00ed v\u00fdstavby a tak\u00e9 sn\u00ed\u017een\u00ed jeho finan\u010dn\u00ed n\u00e1ro\u010dnosti.<\/p>","protected":false},"excerpt":{"rendered":"<p>Ji\u017e za 2 t\u00fddny nabude\u00a0v pln\u00e9 s\u00edle \u00fa\u010dinnosti nov\u00fd stavebn\u00ed z\u00e1kon.
