Ten do z\u00e1kon\u00edku pr\u00e1ce doplnil nov\u00e9 ustanoven\u00ed \u00a7 324a zav\u00e1d\u011bj\u00edc\u00ed \u00fapravu ru\u010den\u00ed dodavatele za mzdov\u00e9 n\u00e1roky zam\u011bstnanc\u016f subdodavatele ve stavebnictv\u00ed.<\/p>\n\n\n\n<p>Od 01.01.2024 je dodavatel nov\u011b odpov\u011bdn\u00fd za mzdy, platy a odm\u011bny zam\u011bstnanc\u016f subdodavatele v\u00a0rozsahu, v\u00a0n\u011bm\u017e se zam\u011bstnanci pod\u00edleli na smluvn\u00edm pln\u011bn\u00ed pro tohoto dodavatele. Pokud subdodavatel sv\u00e9mu zam\u011bstnanci nevyplat\u00ed mzdu, m\u016f\u017ee se zam\u011bstnanec do uplynut\u00ed 3 m\u011bs\u00edc\u016f obr\u00e1tit s\u00a0v\u00fdzvou k\u00a0v\u00fdplat\u011b na dodavatele. Odpov\u011bdnost se vztahuje a\u017e do v\u00fd\u0161e minim\u00e1ln\u00ed mzdy.<\/p>\n\n\n\n<p>Za dodavatele se pro \u00fa\u010dely dan\u00e9ho ustanoven\u00ed pova\u017euje stavebn\u00ed podnikatel podle \u00a7 14 p\u00edsm. d) stavebn\u00edho z\u00e1kona. T\u00edm je osoba s \u017eivnostensk\u00fdm opr\u00e1vn\u011bn\u00edm k prov\u00e1d\u011bn\u00ed staveb, kter\u00e1 zaji\u0161\u0165uje dan\u00e9 stavebn\u00ed pr\u00e1ce prost\u0159ednictv\u00edm subdodavatele. Za subdodavatele se pak pova\u017euje tak\u00e9 agentura pr\u00e1ce, kter\u00e1 k&nbsp;dodavateli do\u010dasn\u011b p\u0159id\u011blila sv\u00e9 zam\u011bstnance.<\/p>\n\n\n\n<p>Subdodavatel m\u00e1 pak informa\u010dn\u00ed povinnost v\u016f\u010di sv\u00fdm zam\u011bstnanc\u016fm v&nbsp;rozsahu dan\u00e9ho ustanoven\u00ed. Tzn. mus\u00ed je zejm\u00e9na pou\u010dit o osob\u011b dodavatele (ru\u010ditele) a o pr\u00e1vu uplatnit u n\u011bj n\u00e1rok na v\u00fdplatu mzdy v&nbsp;p\u0159\u00edpad\u011b, \u017ee subdodavatel (jako jejich zam\u011bstnavatel) jejich n\u00e1rok neuspokoj\u00ed.<\/p>\n\n\n\n<p>Z&nbsp;hlediska dodavatel\u016f je vhodn\u00e9 spr\u00e1vn\u011b nastavit smluvn\u00ed vztah, aby byla jejich odpov\u011bdnost za podm\u00ednek z\u00e1kona p\u0159\u00edpadn\u011b vylou\u010dena, \u010di alespo\u0148 omezena.
