Podle Nejvy\u0161\u0161\u00edho soudu toti\u017e dovol\u00e1n\u00ed neobsahovalo vymezen\u00ed jednoho z\u00a0p\u0159edpoklad\u016f p\u0159\u00edpustnosti dovol\u00e1n\u00ed. \u00dastavn\u00ed soud se postavil proti form\u00e1ln\u00edmu v\u00fdkladu pr\u00e1va a zru\u0161il odm\u00edtav\u00e9 usnesen\u00ed Nejvy\u0161\u0161\u00edho soudu.<\/p>\n\n\n\n<p>Podle \u00dastavn\u00edho soudu je dostate\u010dn\u00e9, pokud alespo\u0148 jeden z\u00a0p\u0159edpoklad\u016f p\u0159\u00edpustnosti dovol\u00e1n\u00ed vypl\u00fdv\u00e1 z\u00a0argumentace obsa\u017een\u00e9 v\u00a0dovol\u00e1n\u00ed. Dovol\u00e1n\u00ed z\u00e1rove\u0148 nemus\u00ed obsahovat odkaz na konkr\u00e9tn\u00ed ustanoven\u00ed ob\u010dansk\u00e9ho soudn\u00edho \u0159\u00e1du. Pokud dovolatel p\u0159edest\u0159e konkr\u00e9tn\u00ed pr\u00e1vn\u00ed ot\u00e1zku a uvede nap\u0159. konkr\u00e9tn\u00ed judikaturu, od\u00a0kter\u00e9 se odvolac\u00ed soud odch\u00fdlil, spln\u00ed t\u00edm po\u017eadavek na vymezen\u00ed p\u0159\u00edpustnosti dovol\u00e1n\u00ed dle z\u00e1kona. Dovol\u00e1n\u00ed je toti\u017e nutn\u00e9 posuzovat podle obsahu.<\/p>\n\n\n\n<p>Z\u00a0hlediska p\u0159\u00edpustnosti dovol\u00e1n\u00ed nen\u00ed ani nutn\u00e9, aby se odvolac\u00ed soud odch\u00fdlil v\u00fdlu\u010dn\u011b od judikatury Nejvy\u0161\u0161\u00edho soudu. Dovol\u00e1n\u00ed je p\u0159\u00edpustn\u00e9 i tehdy, pokud se odvolac\u00ed soud odch\u00fdl\u00ed od judikatury \u00dastavn\u00edho soudu, Evropsk\u00e9ho soudu pro lidsk\u00e1 pr\u00e1va nebo Soudn\u00edho dvora Evropsk\u00e9 unie.<\/p>\n\n\n\n<p>\u00dastavn\u00ed soud tedy navazuje na svou d\u0159\u00edv\u011bj\u0161\u00ed judikaturu, kter\u00e1 odm\u00edt\u00e1 formalistick\u00fd v\u00fdklad procesn\u00edch p\u0159edpis\u016f.<\/p>\n\n\n\n<p>P\u0159i poskytov\u00e1n\u00ed na\u0161ich pr\u00e1vn\u00edch slu\u017eeb zastupujeme klienty tak\u00e9 v&nbsp;\u0159\u00edzen\u00edch p\u0159ed Nejvy\u0161\u0161\u00edm soudem \u010di \u00dastavn\u00edm soudem.
