V&nbsp;takov\u00e9m p\u0159\u00edpad\u011b by tedy nov\u00fd stavebn\u00ed z\u00e1kon nabyl \u00fa\u010dinnosti dne 1. 1. 2024. V&nbsp;tomto \u010dl\u00e1nku se pod\u00edv\u00e1me na to, co bude \u00fa\u010dinnost nov\u00e9ho stavebn\u00edho z\u00e1kona znamenat pro stavebn\u00edky a jejich rozpracovan\u00e9 projekty.<\/p>\n\n\n\n<p>P\u0159echodn\u00e1 ustanoven\u00ed nov\u00e9ho stavebn\u00edho z\u00e1kona zav\u00e1d\u00ed tzv. <strong>p\u0159echodn\u00e9 obdob\u00ed<\/strong>, kter\u00fdm se rozum\u00ed doba <strong>od 1. 1. 2024 do 30.&nbsp;6. 2024.<\/strong> V&nbsp;r\u00e1mci tohoto p\u0159echodn\u00e9ho obdob\u00ed by pak m\u011bla platit n\u00e1sleduj\u00edc\u00ed pravidla pro veden\u00ed povolovac\u00edch \u0159\u00edzen\u00ed, zpracov\u00e1n\u00ed dokumentace a vyu\u017eit\u00ed podkladov\u00fdch stanovisek.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>1) Postup dle dosavadn\u00ed pr\u00e1vn\u00ed \u00fapravy<\/strong><\/h6>\n\n\n\n<p>Obecn\u011b se ve v\u011bcech stavebn\u00edch z\u00e1m\u011br\u016f v\u00a0p\u0159echodn\u00e9m obdob\u00ed postupuje <strong>podle dosavadn\u00edch pr\u00e1vn\u00edch p\u0159edpis\u016f.<\/strong><\/p>\n\n\n\n<p>     <\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>2) Dokon\u010den\u00ed prob\u00edhaj\u00edc\u00edch \u0159\u00edzen\u00ed<\/strong><\/h6>\n\n\n\n<p>\u0158\u00edzen\u00ed a postupy zah\u00e1jen\u00e9 do konce p\u0159echodn\u00e9ho obdob\u00ed se dokon\u010d\u00ed <strong>podle dosavadn\u00edch pr\u00e1vn\u00edch p\u0159edpis\u016f<\/strong>. Pokud tedy dojde k&nbsp;zah\u00e1jen\u00ed \u00fazemn\u00edho \u0159\u00edzen\u00ed nejpozd\u011bji do 30. 6. 2024, toto \u0159\u00edzen\u00ed se dokon\u010d\u00ed podle dnes platn\u00e9ho stavebn\u00edho z\u00e1kona.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>3)<\/strong><strong> Prov\u00e1d\u011bc\u00ed pr\u00e1vn\u00ed p\u0159edpisy<\/strong><\/h6>\n\n\n\n<p>Do doby vyd\u00e1n\u00ed prov\u00e1d\u011bc\u00edch pr\u00e1vn\u00edch p\u0159edpis\u016f, nejpozd\u011bji v\u0161ak <strong>do 1.&nbsp;7. 2027<\/strong>, se postupuje <strong>podle prov\u00e1d\u011bc\u00edch pr\u00e1vn\u00edch p\u0159edpis\u016f k&nbsp;platn\u00e9mu stavebn\u00edmu z\u00e1konu. <\/strong>Zde se jedn\u00e1 zejm\u00e9na o prov\u00e1d\u011bc\u00ed p\u0159edpisy upravuj\u00edc\u00ed detailn\u00ed po\u017eadavky na vyu\u017e\u00edv\u00e1n\u00ed \u00fazem\u00ed a po\u017eadavky na stavby, zejm\u00e9na tedy vyhl\u00e1\u0161ky \u010d. 501\/2006 Sb. a \u010d. 268\/2009 Sb. D\u00e1le se jedn\u00e1 o Pra\u017esk\u00e9 stavebn\u00ed p\u0159edpisy. Platnost t\u011bchto prov\u00e1d\u011bc\u00edch pr\u00e1vn\u00edch p\u0159edpis\u016f se tedy bude odv\u00edjet od p\u0159ijet\u00ed prov\u00e1d\u011bc\u00edch p\u0159edpis\u016f k&nbsp;nov\u00e9mu stavebn\u00edmu z\u00e1konu. \u00dapln\u00fd p\u0159echod na nov\u00e9 prov\u00e1d\u011bc\u00ed p\u0159edpisy by m\u011bl nastat nejpozd\u011bji od 1. 7. 2027.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>4) Ji\u017e zpracovan\u00e1 projektov\u00e1 dokumentace<\/strong><\/h6>\n\n\n\n<p>Jako sou\u010d\u00e1st \u017e\u00e1dosti o&nbsp;povolen\u00ed stavby nebo o&nbsp;r\u00e1mcov\u00e9 povolen\u00ed podan\u00e9 do 30.&nbsp;6. 2027 <strong>lze nam\u00edsto<\/strong> projektov\u00e9 dokumentace zpracovan\u00e9 podle nov\u00e9ho stavebn\u00edho z\u00e1kona <strong>p\u0159edlo\u017eit i&nbsp;dokumentaci zpracovanou podle dosavadn\u00edch pr\u00e1vn\u00edch p\u0159edpis\u016f<\/strong>. Takov\u00fd postup je mo\u017en\u00fd v&nbsp;p\u0159\u00edpad\u011b:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>projektov\u00e9 dokumentace nebo dokumentace pro ohl\u00e1\u0161en\u00ed stavby,<\/li>\n\n\n\n<li>projektov\u00e9 dokumentace pro vyd\u00e1n\u00ed rozhodnut\u00ed o um\u00edst\u011bn\u00ed stavby, dopln\u011bn\u00e9 o architektonicko-stavebn\u00ed \u0159e\u0161en\u00ed a stavebn\u011b konstruk\u010dn\u00ed \u0159e\u0161en\u00ed,<\/li>\n\n\n\n<li>projektov\u00e9 dokumentace pro vyd\u00e1n\u00ed stavebn\u00edho povolen\u00ed nebo dokumentace pro vyd\u00e1n\u00ed spole\u010dn\u00e9ho povolen\u00ed.<\/li>\n<\/ul>\n\n\n\n<p>Nov\u00fd stavebn\u00ed z\u00e1kon tedy za ur\u010dit\u00fdch podm\u00ednek umo\u017e\u0148uje do 30. 6. 2027 vyu\u017e\u00edt i projektovou dokumentace <strong>zpracovanou dle dosavadn\u00edch pr\u00e1vn\u00edch p\u0159edpis\u016f. <\/strong>Nehroz\u00ed tedy, \u017ee by stavebn\u00edk musel vyhodit ji\u017e zpracovanou projektovou dokumentaci do ko\u0161e.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>5) Prov\u00e1d\u011bn\u00ed staveb<\/strong><\/h6>\n\n\n\n<p>Bude-li <strong>prov\u00e1d\u011bn\u00ed stavby zah\u00e1jeno<\/strong> <strong>do 30.&nbsp;6. 2027,<\/strong> lze jako dokumentaci pro prov\u00e1d\u011bn\u00ed stavby pou\u017e\u00edt dokumentaci pro prov\u00e1d\u011bn\u00ed stavby <strong>zpracovanou podle dosavadn\u00edch pr\u00e1vn\u00edch p\u0159edpis\u016f<\/strong>. V&nbsp;tomto obdob\u00ed tak lze vyu\u017e\u00edt i dokumentaci pro prov\u00e1d\u011bn\u00ed stavby, pokud bude stavba zah\u00e1jena do 30. 6. 2027.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>6) Pravomocn\u011b um\u00edst\u011bn\u00e9 z\u00e1m\u011bry<\/strong><\/h6>\n\n\n\n<p><strong>Pravomocn\u00e9 \u00fazemn\u00ed rozhodnut\u00ed<\/strong> o&nbsp;um\u00edst\u011bn\u00ed stavby vydan\u00e9 v&nbsp;\u00fazemn\u00edm \u0159\u00edzen\u00ed, v&nbsp;\u00fazemn\u00edm \u0159\u00edzen\u00ed s&nbsp;posouzen\u00edm vliv\u016f na \u017eivotn\u00ed prost\u0159ed\u00ed anebo ve zjednodu\u0161en\u00e9m \u00fazemn\u00edm \u0159\u00edzen\u00ed,&nbsp;<strong>\u00fa\u010dinn\u00fd \u00fazemn\u00ed souhlas<\/strong> a&nbsp;\u00fa\u010dinn\u00e1 ve\u0159ejnopr\u00e1vn\u00ed smlouva a vydan\u00fd regula\u010dn\u00ed pl\u00e1n nahrazuj\u00edc\u00ed \u00fazemn\u00ed rozhodnut\u00ed o&nbsp;um\u00edst\u011bn\u00ed stavby se <strong>pova\u017euj\u00ed <\/strong>za rozhodnut\u00ed<strong> v&nbsp;\u010d\u00e1sti v\u011bci <\/strong>v&nbsp;\u0159\u00edzen\u00ed o&nbsp;povolen\u00ed z\u00e1m\u011bru<strong> podle nov\u00e9ho stavebn\u00edho z\u00e1kona<\/strong>, pokud jimi byl um\u00edst\u011bn z\u00e1m\u011br vy\u017eaduj\u00edc\u00ed povolen\u00ed podle tohoto z\u00e1kona.<\/p>\n\n\n\n<p>Zde je tedy vymezeno pravidlo, \u017ee pravomocn\u00e9 \u00fazemn\u00ed rozhodnut\u00ed \u010di \u00fazemn\u00ed souhlas jsou pova\u017eov\u00e1ny za platn\u00e1 rozhodnut\u00ed tak\u00e9 dle nov\u00e9ho stavebn\u00edho z\u00e1kona. Tato rozhodnut\u00ed se t\u00fdkaj\u00ed ov\u0161em jen \u010d\u00e1sti v\u011bci, a to um\u00edst\u011bn\u00ed stavby. Nov\u00fd stavebn\u00ed z\u00e1kon zav\u00e1d\u00ed jedin\u00e9 povolovac\u00ed \u0159\u00edzen\u00ed a opou\u0161t\u00ed dosavadn\u00ed koncepc\u00ed \u00fazemn\u00edho a stavebn\u00edho \u0159\u00edzen\u00ed. S&nbsp;ohledem na to tedy bude nutn\u00e9 zbylou \u010d\u00e1st z\u00e1m\u011bru \u201edopovolit\u201c podle nov\u00e9ho stavebn\u00edho z\u00e1kona. V&nbsp;rozsahu pravomocn\u00e9ho \u00fazemn\u00edho rozhodnut\u00ed \u010di souhlasu se ji\u017e ov\u0161em z\u00e1m\u011br znovu povolovat nebude.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>7) Z\u00e1vazn\u00e1 stanoviska, vyj\u00e1d\u0159en\u00ed a podkladov\u00e9 akty<\/strong><\/h6>\n\n\n\n<p>Z\u00e1vazn\u00e1 stanoviska, stanoviska, souhlasy, pop\u0159\u00edpad\u011b rozhodnut\u00ed dot\u010den\u00fdch org\u00e1n\u016f, stanoviska vlastn\u00edk\u016f ve\u0159ejn\u00e9 dopravn\u00ed nebo technick\u00e9 infrastruktury a&nbsp;jin\u00e1 vyj\u00e1d\u0159en\u00ed vydan\u00e1 do konce p\u0159echodn\u00e9ho obdob\u00ed se <strong>pova\u017euj\u00ed rovn\u011b\u017e za podklady pro vyd\u00e1n\u00ed rozhodnut\u00ed v&nbsp;\u0159\u00edzen\u00edch podle nov\u00e9ho stavebn\u00edho z\u00e1kona<\/strong>.<\/p>\n\n\n\n<p>Tyto podkladov\u00e9 akty stavebn\u00ed \u00fa\u0159ad ji\u017e <strong>nep\u0159ezkoum\u00e1v\u00e1<\/strong> a&nbsp;jimi chr\u00e1n\u011bn\u00e9 ve\u0159ejn\u00e9 z\u00e1jmy <strong>znovu<\/strong> <strong>neposuzuje<\/strong>. Podkladov\u00e9 akty vydan\u00e9 do 30. 6. 2024 tedy nen\u00ed nutn\u00e9 vyd\u00e1vat znovu podle nov\u00e9ho stavebn\u00edho z\u00e1kona. Tyto akty je mo\u017en\u00e9 bez dal\u0161\u00edho pou\u017e\u00edt v&nbsp;prob\u00edhaj\u00edc\u00edch \u0159\u00edzen\u00edch.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>8) Z\u00e1m\u011bry, kter\u00e9 nov\u011b nevy\u017eaduj\u00ed povolen\u00ed<\/strong><\/h6>\n\n\n\n<p>\u0158\u00edzen\u00ed a postupy zah\u00e1jen\u00e9 p\u0159ede dnem nabyt\u00ed \u00fa\u010dinnosti tohoto z\u00e1kona, kter\u00e9 se t\u00fdkaj\u00ed z\u00e1m\u011br\u016f, u nich\u017e <strong>nen\u00ed vy\u017eadov\u00e1no povolen\u00ed z\u00e1m\u011bru<\/strong>, jin\u00e9 rozhodnut\u00ed nebo \u00fakon podle nov\u00e9ho stavebn\u00edho z\u00e1kona, stavebn\u00ed \u00fa\u0159ad usnesen\u00edm <strong>zastav\u00ed<\/strong>; proti tomuto usnesen\u00ed se nelze odvolat.<\/p>\n\n\n\n<p>Pokud by tedy bylo zah\u00e1jeno jak\u00e9koliv \u0159\u00edzen\u00ed o z\u00e1m\u011bru, kter\u00fd by ji\u017e podle nov\u00e9ho stavebn\u00edho z\u00e1kona nevy\u017eadoval povolen\u00ed \u010di rozhodnut\u00ed, pak se takov\u00e9 \u0159\u00edzen\u00ed zastav\u00ed.<\/p>\n\n\n\n<p>Jen pro \u00faplnost dopln\u00edme, \u017ee specifick\u00e1 je \u00faprava u tzv. vyhrazen\u00fdch staveb (dr\u00e1hy, d\u00e1lnice, p\u0159enosov\u00e9 soustavy, v\u00fdrobny energie apod.), u kter\u00fdch se v\u00fd\u0161e uveden\u00e1 pravidla neuplatn\u00ed, jsou v\u00fdrazn\u011bji modifikov\u00e1na.<\/p>\n\n\n\n<p>Proces schvalov\u00e1n\u00ed nov\u00e9ho stavebn\u00edho z\u00e1kona dlouhodob\u011b sledujeme. Nov\u00fd stavebn\u00ed z\u00e1kon p\u0159itom p\u0159in\u00e1\u0161\u00ed celou \u0159adu zm\u011bn pravidel, kter\u00fdmi se dnes \u0159\u00edd\u00ed stavebn\u00edci a povolov\u00e1n\u00ed jejich z\u00e1m\u011br\u016f. T\u011bmito zm\u011bnami V\u00e1s r\u00e1di provedeme.
