Z\u00e1kon byl ji\u017e publikov\u00e1n ve sb\u00edrce a \u00fa\u010dinnosti nabude k 01.08.2023. Jak\u00e9 povinnosti p\u0159in\u00e1\u0161\u00ed?<\/p>\n\n\n\n<p>Z\u00e1kon si d\u00e1v\u00e1 za c\u00edl chr\u00e1nit oznamovatele (zejm\u00e9na v pozici zam\u011bstnanc\u016f) p\u0159i oznamov\u00e1n\u00ed protipr\u00e1vn\u00edho jedn\u00e1n\u00ed u zam\u011bstnavatele \u010di obchodn\u00edho partnera. Jde o to, aby se nap\u0159. zam\u011bstnavatel nemohl mst\u00edt za to, \u017ee zam\u011bstnanec na takov\u00e9 z\u00e1vadn\u00e9 jedn\u00e1n\u00ed upozornil. Ochrana z\u00e1kona se v\u0161ak vztahuje pouze na vybran\u00e9 z\u00e1va\u017en\u00e9 skutky, jak\u00fdmi jsou nap\u0159. trestn\u00e9 \u010diny, \u010dinnosti poru\u0161uj\u00edc\u00ed pr\u00e1vn\u00ed p\u0159edpisy v oblasti finan\u010dn\u00edch slu\u017eeb, dan\u011b z p\u0159\u00edjmu apod.<\/p>\n\n\n\n<p>Pr\u00e1vn\u00ed \u00faprava nakonec upou\u0161t\u00ed od mo\u017enosti anonymn\u00edho ozn\u00e1men\u00ed a v\u017edy je tak zapot\u0159eb\u00ed oznamovatele z ozn\u00e1men\u00ed identifikovat. Je nicm\u00e9n\u011b ot\u00e1zkou, do jak\u00e9 m\u00edry je takov\u00e1 \u00faprava v souladu s transponovanou sm\u011brnic\u00ed? <\/p>\n\n\n\n<p>N\u011bkter\u00fdm subjekt\u016fm pak z\u00e1kon stanov\u00ed povinnost zav\u00e9st vnit\u0159n\u00ed oznamovac\u00ed syst\u00e9m (povinn\u00e9 subjekty). Prost\u0159ednictv\u00edm tohoto syst\u00e9mu by pak m\u011blo doch\u00e1zet k pod\u00e1v\u00e1n\u00ed a vy\u0159izov\u00e1n\u00ed jednotliv\u00fdch ozn\u00e1men\u00ed. V soukrom\u011b sf\u00e9\u0159e se jedn\u00e1 p\u0159edev\u0161\u00edm o zam\u011bstnavatele zam\u011bstn\u00e1vaj\u00edc\u00ed alespo\u0148 50 zam\u011bstnanc\u016f.<\/p>\n\n\n\n<p>Vnit\u0159n\u00ed oznamovac\u00ed syst\u00e9m musej\u00ed povinn\u00e9 subjekty zav\u00e9st nejpozd\u011bji do \u00fa\u010dinnosti z\u00e1kona (01.08.2023) s v\u00fdjimkou zam\u011bstnavatel\u016f zam\u011bstn\u00e1vaj\u00edc\u00edch v\u00edce jak 50, ale m\u00e9n\u011b ne\u017e 250 zam\u011bstnanc\u016f. Ti maj\u00ed lh\u016ftu prodlou\u017eenou do 15.12.2023.<\/p>\n\n\n\n<p>Vedle vnit\u0159n\u00edho oznamovac\u00edho syst\u00e9mu mus\u00ed povinn\u00e9 subjekty ur\u010dit tak\u00e9 p\u0159\u00edslu\u0161nou osobu, kter\u00e1 bude jednotliv\u00e1 ozn\u00e1men\u00ed posuzovat a prov\u011b\u0159ovat ozn\u00e1men\u00e9 skute\u010dnosti. P\u0159\u00edslu\u0161nou osobou bude moci b\u00fdt pouze osoba fyzick\u00e1, kter\u00e1 mus\u00ed p\u0159i vy\u0159izov\u00e1n\u00ed ozn\u00e1men\u00ed p\u016fsobit nestrann\u011b a zachov\u00e1vat d\u016fv\u011brnost z\u00edskan\u00fdch informac\u00ed. Z\u00e1rove\u0148 by m\u011bla m\u00edt dostate\u010dn\u011b odborn\u00e9 znalosti k posouzen\u00ed protipr\u00e1vnosti prov\u011b\u0159ovan\u00e9ho skutku.
