N\u011bkter\u00e1 SVJ p\u0159istoupila k\u00a0\u0159e\u0161en\u00ed tak, \u017ee takov\u00fd z\u00e1kaz vt\u011blila dokonce p\u0159\u00edmo do stanov. S\u00a0definitivn\u00edm \u0159e\u0161en\u00edm ale p\u0159i\u0161el ned\u00e1vno Nejvy\u0161\u0161\u00ed soud. Podle n\u011bho SVJ kr\u00e1tkodob\u00fd pron\u00e1jem bytu, a to ani ve stanov\u00e1ch, zak\u00e1zat nem\u016f\u017ee (usnesen\u00ed ze dne 15.03.2023, sp. zn. <a href=\"https:\/\/www.nsoud.cz\/Judikatura\/judikatura_ns.nsf\/WebSearch\/848F88DF08BE97BDC125898F0036C11C?openDocument&amp;Highlight=0,\">26 Cdo 854\/2022<\/a>).<\/p>\n\n\n\n<p>Podle Nejvy\u0161\u0161\u00edho soudu toti\u017e m\u016f\u017ee SVJ rozhodovat pouze v\u00a0oblastech spr\u00e1vy, provozu, \u00fadr\u017eby, oprav domu, jeho spole\u010dn\u00fdch \u010d\u00e1st\u00ed a pozemku. Nem\u016f\u017ee v\u0161ak zasahovat do vlastnick\u00fdch pr\u00e1v k byt\u016fm (jednotk\u00e1m) jednotliv\u00fdch vlastn\u00edk\u016f. Proto\u00a0SVJ nem\u016f\u017ee vlastn\u00edk\u016fm zak\u00e1zat kr\u00e1tkodob\u00e9 pronaj\u00edm\u00e1n\u00ed byt\u016f, ani jinak omezit zp\u016fsob u\u017e\u00edv\u00e1n\u00ed bytu. Na takov\u00e9 rozhodnut\u00ed SVJ (zm\u011bnu\u00a0stanov) se hled\u00ed, jako by v\u016fbec nebylo p\u0159ijato.<\/p>\n\n\n\n<p>Jak tedy postupovat, pokud vlastn\u00edk jednotky u\u017e\u00edv\u00e1 byt k jin\u00e9mu \u00fa\u010delu, ne\u017e vypl\u00fdv\u00e1 z prohl\u00e1\u0161en\u00ed vlastn\u00edka nap\u0159. Airbnb)? Pokud\u00a0vlastn\u00edk takov\u00fdm zp\u016fsobem opakovan\u011b (dlouhodob\u011b) ru\u0161\u00ed obvykl\u00fd klid a po\u0159\u00e1dek v dom\u011b, m\u016f\u017ee SVJ postupovat podle <a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/2012-89#p1184\">\u00a7 1184 odst. 1<\/a> ob\u010dansk\u00e9ho z\u00e1kon\u00edku a navrhnout nucen\u00fd prodej jednotky. V\u00fdzva pak mus\u00ed nav\u00edc obsahovat i upozorn\u011bn\u00ed na mo\u017enost nucen\u00e9ho prodeje jednotky.<\/p>\n\n\n\n<p>Oblast bytov\u00e9ho spoluvlastnictv\u00ed pat\u0159\u00ed mezi jednu ze specializac\u00ed na\u0161\u00ed advok\u00e1tn\u00ed kancel\u00e1\u0159e.
