Jeho z\u00e1v\u011bry mohou m\u00edt d\u016fsledky jak pro municipality, kter\u00e9 p\u0159ipravuj\u00ed \u00fazemn\u00ed pl\u00e1n \u010di jeho zm\u011bnu, tak pro samotn\u00e9 vlastn\u00edky nemovitost\u00ed. Z\u00e1rove\u0148 se jedn\u00e1 o p\u0159\u00edpad, na kter\u00e9m s\u00a0obc\u00ed spolupracoval n\u00e1\u0161 kolega <a href=\"http:\/\/kodaplegal.cz\/en\/kontakt\/\">Ji\u0159\u00ed Voz\u00e1k<\/a> a ve kter\u00e9m p\u0159ed spr\u00e1vn\u00edm soudem \u00fasp\u011b\u0161n\u011b h\u00e1jil \u00fazemn\u00ed pl\u00e1n na\u0161eho klienta.<\/p>\n\n\n\n<p><strong>Po\u017eadavky na odstavn\u00e1 st\u00e1n\u00ed<\/strong><\/p>\n\n\n\n<p>Obec ve sv\u00e9m \u00fazemn\u00edm pl\u00e1nu stanovila po\u017eadavek na minim\u00e1ln\u00ed plochu odstavn\u00fdch st\u00e1n\u00ed pro jednotliv\u00e9 bytov\u00e9 jednotky. Obec tento regulativ vymezila tak, \u017ee na ka\u017edou bytovou jednotku do 80 m<sup>2<\/sup> jsou nutn\u00e1 minim\u00e1ln\u011b dv\u011b odstavn\u00e1 st\u00e1n\u00ed. Pro bytov\u00e9 jednotky nad 80 m<sup>2<\/sup> podlahov\u00e9 plochy pak \u00fazemn\u00ed pl\u00e1n vy\u017eaduje alespo\u0148 t\u0159i odstavn\u00e1 st\u00e1n\u00ed. Vlastn\u00edk pozemku pova\u017eoval takov\u00e9 po\u017eadavky za nep\u0159im\u011b\u0159en\u00e9 a srovn\u00e1val je mj. s pra\u017esk\u00fdmi stavebn\u00edmi p\u0159edpisy (na\u0159\u00edzen\u00ed hlavn\u00edho m\u011bsta Prahy \u010d. 10\/2016 Sb. hl. m. Prahy). T\u011bmi se stanovuj\u00ed obecn\u00e9 po\u017eadavky na vyu\u017e\u00edv\u00e1n\u00ed \u00fazem\u00ed a technick\u00e9 po\u017eadavky na stavby v hlavn\u00edm m\u011bst\u011b Praze.<\/p>\n\n\n\n<p>Krajsk\u00fd soud v\u00a0Praze v rozsudku \u010d. j. 43 A 104\/2022- 104 ze dne 28. 3. 2023 uvedl, \u017ee v\u00a0p\u0159\u00edpad\u011b mal\u00e9 obce lze p\u0159edpokl\u00e1dat pou\u017e\u00edv\u00e1n\u00ed v\u00edce motorov\u00fdch vozidel v jedn\u00e9 dom\u00e1cnosti. Podle soudu \u201e<em>nelze na \u00fazem\u00ed obce Tachlovice naz\u00edrat stejnou optikou jako na velkom\u011bstskou z\u00e1stavbu v metropoli, kde je zpravidla zaji\u0161t\u011bna podstatn\u011b kvalitn\u011bj\u0161\u00ed infrastruktura ve\u0159ejn\u00e9 hromadn\u00e9 dopravy, co\u017e znamen\u00e1 ni\u017e\u0161\u00ed pot\u0159ebu osobn\u00ed automobilov\u00e9 dopravy u rezident\u016f. Naopak v obci, jako jsou Tachlovice, lze d\u016fvodn\u011b p\u0159edpokl\u00e1dat, \u017ee vyu\u017eit\u00ed osobn\u00edch motorov\u00fdch vozidel k doprav\u011b bude intenzivn\u011bj\u0161\u00ed, co\u017e klade odli\u0161n\u00e9 n\u00e1roky i na dopravu v klidu.\u201c <\/em>. V\u00fd\u0161e popsan\u00fd po\u017eadavek na parkovac\u00ed st\u00e1n\u00ed je tak dle Krajsk\u00e9ho soudu v\u00a0Praze v\u00a0po\u0159\u00e1dku.<\/p>\n\n\n\n<p><strong>Napojen\u00ed na \u010dist\u00edrnu odpadn\u00edch vod (\u010cOV) \u010di z\u0159\u00edzen\u00ed vlastn\u00ed \u010cOV<\/strong><\/p>\n\n\n\n<p>Podle \u00fazemn\u00edho pl\u00e1nu je mo\u017en\u00e9 z\u0159\u00eddit samostatnou \u010cOV jen za spln\u011bn\u00ed 2 podm\u00ednek. V\u00a0prvn\u00ed \u0159ad\u011b bude dolo\u017eena nemo\u017enost p\u0159ipojen\u00ed dal\u0161\u00edch objekt\u016f na kanalizaci z d\u016fvodu napln\u011bn\u00ed kapacity obecn\u00ed \u010cOV. Druhou podm\u00ednkou je dolo\u017een\u00ed technick\u00e9 nemo\u017enosti intenzifikace obecn\u00ed \u010cOV. Vlastn\u00edk pozemku pova\u017eoval tyto podm\u00ednky za projev libov\u016fle obce.<\/p>\n\n\n\n<p>Krajsk\u00fd soud v\u0161ak obci i v\u00a0tomto p\u0159\u00edpad\u011b p\u0159isv\u011bd\u010dil. Podle soudu <em>\u201estanoven\u00ed po\u017eadavk\u016f pro napojen\u00ed na \u010cOV je legitimn\u00ed a \u00fazemn\u00ed pl\u00e1n naopak stanov\u00ed konkr\u00e9tn\u00ed podm\u00ednky, za kter\u00fdch bude mo\u017en\u00e9 vystav\u011bt soukromou \u010cOV. Z\u00e1rove\u0148 odp\u016frkyn\u011b v rozhodnut\u00ed o n\u00e1mitk\u00e1ch uplatn\u011bn\u00fdch p\u0159i opakovan\u00e9m ve\u0159ejn\u00e9m projedn\u00e1n\u00ed v\u00fdslovn\u011b uvedla, \u017ee kapacita \u010cOV by m\u011bla pl\u00e1nov\u00e9 v\u00fdstavb\u011b posta\u010dovat.\u201c<\/em>. Podm\u00edn\u011bn\u00ed v\u00fdstavby vlastn\u00ed \u010cOV v\u00fd\u0161e uveden\u00fdm zp\u016fsobem je tedy dle spr\u00e1vn\u00edho soudu p\u0159\u00edpustn\u00e9.<\/p>\n\n\n\n<p><strong>Omezen\u00ed po\u010dtu podla\u017e\u00ed a bytov\u00fdch jednotek ve&nbsp;dvojdomech<\/strong><\/p>\n\n\n\n<p>Obec se v\u00a0\u00daP rozhodla v jedn\u00e9 lokalit\u011b stanovit maxim\u00e1ln\u00ed v\u00fd\u0161ku z\u00e1stavby 11 m a\u00a0sou\u010dasn\u011b um\u00edst\u011bn\u00ed maxim\u00e1ln\u011b dvoupodla\u017en\u00edch staveb. Tak\u00e9 tento regulativ je dle Krajsk\u00e9ho soudu v\u00a0Praze v\u00a0po\u0159\u00e1dku. <em>\u201eJe proto legitimn\u00ed, \u017ee odp\u016frkyn\u011b regulovala v\u00fd\u0161ku budov, v tom d\u016fsledku i jejich podla\u017enost a maxim\u00e1ln\u00ed po\u010det \u0159adov\u00fdch rodinn\u00fdch dom\u016f tak, aby nenaru\u0161ovaly celkovou urbanistickou koncepci obce. [\u2026] Stejn\u011b tak soud pova\u017euje za legitimn\u00ed, \u017ee se obec rozhodla takto kl\u00ed\u010dovou lokalitu, jej\u00ed\u017e z\u00e1stavba bude d\u00e1le z\u00e1sadn\u011b ovliv\u0148ovat budouc\u00ed podobu a charakter obce, regulovat podrobn\u011bji v regula\u010dn\u00edm pl\u00e1nu. Nelze tedy p\u0159isv\u011bd\u010dit argumentaci, \u017ee zm\u011bna regulace z bytov\u00fdch na rodinn\u00e9 domy byla dosta\u010duj\u00edc\u00ed, nebo\u0165 obec by mohla ji\u017e jen velmi omezen\u011b ovlivnit vzhled t\u00e9to kl\u00ed\u010dov\u00e9 lokality.\u201c <\/em><\/p>\n\n\n\n<p>Krajsk\u00fd soud tedy nav\u00e1zal na d\u0159\u00edv\u011bj\u0161\u00ed judikaturu, podle kter\u00e9 zp\u016fsob vyu\u017eit\u00ed zastav\u011bn\u00e9ho \u00fazem\u00ed i v\u00fd\u0161kov\u00e1 regulace z\u00e1stavby mohou b\u00fdt p\u0159edm\u011btem \u00fapravy \u00fazemn\u00edho pl\u00e1nu (srov. rozsudek Nejvy\u0161\u0161\u00edho spr\u00e1vn\u00edho soudu \u010d. j. 8 As 2\/2016-56 ze dne 1. 7. 2016 \u010di rozsudek Krajsk\u00e9ho soudu v Brn\u011b \u010d. 2885\/2013 Sb. NSS).<\/p>\n\n\n\n<p>Naopak podle Krajsk\u00e9ho soudu v&nbsp;Praze nen\u00ed mo\u017en\u00e9 stanovit v&nbsp;\u00fazem\u00edm pl\u00e1nu po\u010det bytov\u00fdch jednotek v&nbsp;rodinn\u00e9m dom\u011b. <em>\u201e<\/em><em>T\u00edmto regulativem se toti\u017e nevymezuje hmotov\u00fd rozsah rodinn\u00e9ho domu ani jeho vn\u011bj\u0161\u00ed podoba, pokud jde o v\u00fd\u0161ku stavby, po\u010det podla\u017e\u00ed, velikost zastav\u011bn\u00e9 plochy \u010di pom\u011br zastav\u011bn\u00e9 plochy v\u016f\u010di cel\u00e9mu stavebn\u00edmu pozemku. Tento regulativ s\u00e1m o sob\u011b nijak nesouvis\u00ed s funk\u010dn\u00edm vyu\u017eit\u00edm ploch ani s vn\u011bj\u0161\u00edm uspo\u0159\u00e1d\u00e1n\u00edm z\u00e1stavby z hlediska urbanistick\u00fdch hodnot. [\u2026] Regulativ omezuj\u00edc\u00ed po\u010det bytov\u00fdch jednotek v rodinn\u00e9m dom\u011b nicm\u00e9n\u011b z\u016fstane v \u010d\u00e1sti zad\u00e1n\u00ed regula\u010dn\u00edho pl\u00e1nu, nebo\u0165 regula\u010dn\u00ed pl\u00e1n pr\u00e1v\u011b tento typ regulace m\u016f\u017ee obsahovat.\u201c <\/em>Takov\u00fd regulativ tedy ji\u017e svoj\u00ed povahou a podrobnost\u00ed p\u0159\u00edslu\u0161\u00ed regula\u010dn\u00edmu pl\u00e1nu.<\/p>\n\n\n\n<p>Jen pro zaj\u00edmavost pak dod\u00e1v\u00e1me, \u017ee nov\u00fd stavebn\u00ed z\u00e1kon \u010d. 283\/2021 Sb., \u0159e\u0161\u00ed mo\u017enost po\u0159\u00edzen\u00ed \u00fazemn\u00edho pl\u00e1nu s regula\u010dn\u00edmi prvky \u010di po\u0159\u00edzen\u00ed regula\u010dn\u00edho pl\u00e1nu obdobn\u011b jako sou\u010dasn\u00e1 pr\u00e1vn\u00ed \u00faprava. V\u00a0tomto ohledu n\u00e1s tedy od 1. 1. 2024, kdy nov\u00fd stavebn\u00ed z\u00e1kon pravd\u011bpodobn\u011b nabude \u00fa\u010dinnosti, ne\u010dek\u00e1 v\u00fdrazn\u011bj\u0161\u00ed koncep\u010dn\u00ed zm\u011bna. Je tak pravd\u011bpodobn\u00e9, \u017ee dosavadn\u00ed soudn\u00ed z\u00e1v\u011bry budou do jist\u00e9 m\u00edry vyu\u017eiteln\u00e9 tak\u00e9 v budoucnu.<\/p>\n\n\n\n<p><strong>Z\u00e1v\u011brem<\/strong><\/p>\n\n\n\n<p>Obec ve spojen\u00ed s\u00a0uveden\u00fdmi regulativy stanovila v\u00a0\u00fazemn\u00edm pl\u00e1nu tak\u00e9 \u0159adu dal\u0161\u00edch po\u017eadavk\u016f jako nap\u0159. z\u00e1vazn\u00e9 prostorov\u00e9 uspo\u0159\u00e1d\u00e1n\u00ed (v plo\u0161e je mo\u017en\u00e9 um\u00edstit maxim\u00e1ln\u011b 14 \u0159adov\u00fdch rodinn\u00fdch dom\u016f nebo dvojdom\u016f), v\u00fd\u0161kov\u00fd regulativ, minim\u00e1ln\u00ed velikost stavebn\u00edho pozemku \u010di pod\u00edl zastav\u011bn\u00fdch a zpevn\u011bn\u00fdch ploch na stavebn\u00edm pozemku. Krajsk\u00fd soud ani tyto po\u017eadavky v jejich kombinaci nevyhodnotil jako nep\u0159im\u011b\u0159en\u00e9.<\/p>\n\n\n\n<p>Na tomto p\u0159\u00edpad\u011b lze uk\u00e1zat, \u017ee se obce mohou vhodnou kombinac\u00ed regulativ\u016f zakotven\u00fdch v\u00a0\u00fazemn\u00edm pl\u00e1nu br\u00e1nit proti nadm\u011brn\u00e9 z\u00e1stavb\u011b, kter\u00e1 by mohla naru\u0161ovat \u017eivot v\u00a0obci a\u00a0jej\u00ed p\u0159\u00edrodn\u00ed a kulturn\u00ed hodnoty.
