Soud z\u00e1rove\u0148 nen\u00ed takov\u00fdm n\u00e1vrhem v\u00e1z\u00e1n a p\u0159i stanoven\u00ed zp\u016fsobu vypo\u0159\u00e1d\u00e1n\u00ed spoluvlastnictv\u00ed postupuje dle z\u00e1kona nehled\u011b na to, co navrhuj\u00ed \u00fa\u010dastn\u00edci \u0159\u00edzen\u00ed (nen\u00ed-li p\u0159edm\u011btem n\u00e1vrhu sm\u00edr).<\/p>\n\n\n\n<p>Bude-li tedy jeden ze spoluvlastn\u00edk\u016f navrhovat nap\u0159. p\u0159ik\u00e1z\u00e1n\u00ed pozemku do jeho v\u00fdlu\u010dn\u00e9ho vlastnictv\u00ed, nen\u00ed soud povinen tento n\u00e1vrh respektovat a m\u016f\u017ee se st\u00e1t, \u017ee jako zp\u016fsob vypo\u0159\u00e1d\u00e1n\u00ed zvol\u00ed privilegovan\u00e9 rozd\u011blen\u00ed v\u011bci.<\/p>\n\n\n\n<p>Se specifi\u010dnost\u00ed takov\u00e9ho \u0159\u00edzen\u00ed souvis\u00ed i odli\u0161n\u00e9 \u0159e\u0161en\u00ed ot\u00e1zky n\u00e1klad\u016f \u0159\u00edzen\u00ed, kdy \u00dastavn\u00ed soud ve sv\u00e9m n\u00e1lezu sp. zn. IV. \u00daS 404\/22 ze dne 05.04.2022 potvrdil, \u017ee v \u0159\u00edzen\u00ed o zru\u0161en\u00ed a vypo\u0159\u00e1d\u00e1n\u00ed spoluvlastnictv\u00ed nelze vych\u00e1zet ze z\u00e1sady \u00fasp\u011bchu ve v\u011bci, ale z\u00a0toho, \u017ee \u017e\u00e1dn\u00fd z\u00a0\u00fa\u010dastn\u00edk\u016f nevych\u00e1z\u00ed z\u00a0\u0159\u00edzen\u00ed s\u00a0men\u0161\u00ed hodnotou, ne\u017e se kterou do n\u011bj vstupoval. I z\u00a0toho d\u016fvodu se v\u00a0t\u011bchto \u0159\u00edzen\u00edch uplatn\u00ed v\u00a0drtiv\u00e9 v\u011bt\u0161in\u011b princip toho, \u017ee \u017e\u00e1dn\u00fd z\u00a0\u00fa\u010dastn\u00edk\u016f nem\u00e1 n\u00e1rok na n\u00e1hradu n\u00e1klad\u016f \u0159\u00edzen\u00ed. <\/p>\n\n\n\n<p>Uveden\u00fd z\u00e1v\u011br \u00dastavn\u00edho soudu jenom podtrh\u00e1v\u00e1 to, \u017ee je-li to mezi spoluvlastn\u00edky alespo\u0148 trochu mo\u017en\u00e9, v\u017edy je v\u00fdhodn\u011bj\u0161\u00ed se na zp\u016fsobu vypo\u0159\u00e1d\u00e1n\u00ed spoluvlastnictv\u00ed dohodnout, ani\u017e by bylo t\u0159eba tuto ot\u00e1zku \u0159e\u0161it p\u0159ed soudem.
